Car Accident Claims process in court






 A Car Accident Claim is a formal request made to an insurance company or a court (Motor Accident Claims Tribunal) to provide financial compensation for losses incurred due to a road accident.

2. Mandatory Documentation

​To process a claim, the following documents are essential:

  • FIR (First Information Report): Mandatory for third-party and personal injury claims.
  • RC (Registration Certificate): Proof of vehicle ownership.
  • Driving License (DL): Must be valid and appropriate for the vehicle class.
  • Insurance Policy: A valid policy at the time of the accident.
  • Medical Certificates: For injury or death claims.

3. Time Limit (Statute of Limitations)

​As per the 2019 amendment, a claim petition should ideally be filed within 6 months of the accident. While courts can sometimes allow delayed filings for valid reasons, prompt filing is highly recommended.

4. Geographical Jurisdiction

​You can file a claim at the Motor Accident Claims Tribunal (MACT):

  • ​Where the accident occurred, OR
  • ​Where the claimant (you) resides, OR
  • ​Where the defendant (other party) resides.

  • Step 1: Inform the Police & Insurer: File an FIR and notify your insurance company immediately.
  • Step 2: Collect Evidence: Take photos of the damage, the location, and note down the details of the other vehicle involved.
  • Step 3: Survey: For vehicle damage, an insurance surveyor will inspect the car before repairs begin.
  • Step 4: MACT Filing: For injury or third-party death, file a case in the Motor Accident Claims Tribunal through a lawyer.
  • Step 5: Settlement/Award: The court or insurer will verify the documents and settle the claim amount.
